1. Who we are
GigWest is an online live-entertainment marketplace operated by Shane Kerr, a sole trader trading under the registered business name Gig West, ABN 94 942 773 304, based in Cowra NSW 2794, Australia.
This Privacy Policy explains how GigWest collects, uses, stores and discloses personal information.
Where the Privacy Act 1988 (Cth) and Australian Privacy Principles apply to GigWest, we handle personal information in accordance with those requirements. We also use the principles in this policy as our baseline for responsible data handling where an exemption or different legal rule may apply.

2. What information we collect
The information GigWest may collect depends on how you use the Platform.
Account and contact information may include name and display name; email address; phone number; password credentials in protected hashed form; account roles, status and preferences; and organisation or venue memberships.
Performer identity and compliance information may include legal, stage or business name; ABN; date of birth for eligibility and compliance; GST status; general home locality and travel radius; insurance information; historical certificate records where applicable; and compliance declarations and records.
SERR and tax-reporting information, where reasonably required, may include legal and registered business names, entity type, ABN, date of birth, address, contact details, financial-account reference information such as an account identifier and routing or BSB information, and accepted booking values and transaction information. Financial-account references are not used by GigWest to debit the account or pay Performer Fees. They are private compliance information protected using encryption and access controls.
Performer profile information may include biography, format, genres, pricing guides, event types, service area, travel radius, availability, photographs, approved media and public insurance-status indicators.
Venue and Hirer information may include organisation and venue name, authorised staff information, event and venue details, operational load-in, stage, production, access and contact information, and private Venue Gig Sheet information supplied for confirmed Bookings.
Enquiries, quotes and booking information may include event date, location and requirements; enquiries, responses and messages; quote versions; Performer Fee and booking terms; GigWest Booking Fee amounts; first/repeat classification; Booking status; cancellations, reschedules and replacement links; review eligibility; and dispute or support records.
Payment information: GigWest uses Stripe for GigWest Booking Fee transactions. GigWest may store payment-provider references, payment status, amounts, refund records and reconciliation information. GigWest does not store raw card numbers or card security codes. Those credentials are handled by Stripe.
Messages, moderation and reports may include messages; blocked or flagged contact-sharing attempts; redacted previews; protected originals where needed for review; user reports; warnings, restrictions and moderation outcomes; and audit records of authorised administrator access.
Documents and attachments. GigWest does not accept new private document, booking-attachment or insurance-certificate uploads at launch. Historical development records, if present, remain private and access-controlled. Promotional performer profile, cover and gallery images use a separate media system and may be public when a profile is published.
Reviews and public content may include reviews from eligible completed Bookings, Performer responses, public event listings, Open Date information and other content a user deliberately publishes.
Technical and security information may include session information, security events, rate-limit records, device/browser information, server logs and protected network identifiers. Where practical, network identifiers may be hashed or minimised.
Support communications include information you provide when contacting support, reporting another user or asking for privacy assistance.
3. Information that may be public
Depending on your role and choices, public information may include:
- Performer stage name and public biography;
- general town or locality and travel radius;
- format, genres and event types;
- public pricing guides;
- approved profile photos and media;
- public insurance-status indicators;
- completed-booking review content and Performer responses;
- public Open Date information; and
- eligible events opted into What's On Western NSW.
Private weddings, private parties and events marked private are not intended to be published through What's On.
4. Information we keep private
Information not intended for public display includes:
- date of birth;
- private legal-identity and SERR information;
- private addresses and financial-account references;
- insurance certificates and policy documents;
- private booking attachments;
- private Venue Gig Sheet credentials and sensitive operational information;
- pre-confirmation contact information;
- protected moderation evidence; and
- private support and administrator records.
Access is limited according to role, Booking status and administrative permission.
5. How we collect information
We may collect information directly from you during registration, profile creation, messaging, quoting, booking, support or compliance processes; from another authorised user acting for a venue or organisation; automatically where necessary for sessions, security, operation or abuse prevention; from payment, hosting, email, storage and security providers; and from government or public sources where reasonably necessary to administer legal and regulatory obligations.
6. Why we use personal information
We may use personal information to:
- create and secure accounts and manage Performer profiles;
- provide search, discovery and relevant opportunity matching;
- operate Gig SOS, Open Dates, Muso Callouts and other marketplace tools;
- provide messaging, quote and booking workflows;
- calculate and process the GigWest Booking Fee;
- confirm Bookings and unlock contact details;
- manage cancellations, refunds, rescheduling and Booking Protection;
- maintain booking, payment and audit records;
- administer reviews, reports and support;
- prevent fraud, spam, abuse and marketplace bypass attempts;
- meet tax, SERR, accounting and regulatory obligations;
- maintain security and reliability;
- communicate service and account information; and
- improve the Platform and understand feature use.
We do not sell personal information to advertisers.
7. Automated processing and decisions
GigWest uses computer systems to support parts of the marketplace. Depending on the feature, personal information may be used to rank or filter search results; assess geographic eligibility; check availability conflicts; identify relevant Gig SOS opportunities; calculate first or repeat Booking Fee treatment; expire quotes, opportunities or unpaid acceptances; detect pre-confirmation contact sharing, spam or suspicious patterns; apply configured messaging restrictions; and determine eligibility for Platform workflows.
Some processes may affect what features, listings or communications are available. GigWest may make human review available for material moderation or account-restriction decisions through support.
We describe these processes for transparency and to accommodate privacy-law requirements that may apply to automated decisions from 10 December 2026.
8. Cookies and sessions
GigWest uses cookies or similar browser storage reasonably necessary to keep users signed in, maintain security and operate the Platform.
GigWest does not currently use third-party advertising trackers as part of the ordinary Platform experience. If that changes, this policy and any required consent mechanism will be updated.
9. Email and communications
GigWest may send transactional or service communications such as account verification, password reset, quote, Booking, cancellation, payment, support and security notices.
Marketing communications will be sent only where permitted by applicable law and will include an appropriate opt-out where required. Opting out of marketing does not prevent essential service communications.
10. Who we disclose information to
GigWest may disclose information where reasonably necessary to the other party to a confirmed Booking; authorised venue or organisation staff; Stripe and other payment providers; hosting, database, cloud-storage and content-delivery providers; transactional email providers; security, monitoring, malware-scanning and infrastructure providers; professional advisers; government bodies, regulators, courts or law enforcement where required or authorised, including the ATO where applicable; and an entity involved in a genuine business restructure or transfer subject to applicable privacy obligations.
We disclose only information reasonably necessary for the relevant purpose.
11. Overseas processing and disclosure
Some technology and service providers used by GigWest may store or process information outside Australia. Depending on the providers and infrastructure actually used, those countries may include the United States and other locations in which the relevant provider operates.
Where practicable, GigWest may choose Australian data regions. Global payment, email, security or support providers may nevertheless process information elsewhere. GigWest will keep this section aligned with the production providers actually in use.
Where Australian privacy law requires it, GigWest will take reasonable steps concerning overseas disclosures and will update this policy when countries of likely disclosure can practicably be identified more specifically.
12. Security
GigWest uses technical and organisational measures intended to protect information against unauthorised access, loss, misuse or disclosure.
Depending on the information, these measures may include password hashing, encrypted storage for selected compliance or venue secrets, role-based access controls, private file storage, time-limited file access, malware screening, audit logs, rate limiting, multi-factor controls for sensitive administration and payment-provider security controls.
No online service can guarantee absolute security. Users must keep credentials secure and contact GigWest promptly if they believe an account has been compromised.
13. Retention
GigWest keeps information only for as long as reasonably required for its purpose, legal requirements, tax and regulatory obligations, security, fraud prevention, audit and dispute handling.
Booking, audit, dispute and selected private-document records may commonly be retained up to seven years where appropriate. SERR reporting and frozen reporting records may be retained for at least the applicable statutory or operational period, including a minimum five-year period where configured. Active account and profile information is generally retained while the account remains active and then deleted, anonymised or retained only where another lawful or operational reason applies.
Backups may retain deleted information for a limited additional period before normal rotation.
14. Account closure
You may request account closure, subject to any active Booking that must first be resolved.
GigWest may remove or anonymise personal identifiers, revoke sessions, archive public profiles and close eligible listings. Closing an account does not necessarily delete all Booking, payment, audit, moderation, tax or dispute records. Those records may be retained or de-identified where reasonably necessary.
15. Access and correction
You can update many account and profile details through your dashboard. You may contact GigWest to request access to personal information or correction of inaccurate information. We may need to verify your identity.
There may be circumstances where access or correction can lawfully be refused or limited. If that occurs, we will explain the reason where required by law.
16. Data export
Where the Platform provides an account-data export, it may include account information, roles, profile data, organisation memberships, enquiries, messages, Bookings, notifications and reviews associated with your account.
Some protected records may be omitted or handled separately where disclosure could affect another person's privacy, platform security, legal privilege, moderation integrity or another lawful restriction.
17. Data breaches
If GigWest becomes aware of suspected unauthorised access, disclosure or loss of personal information, it will assess the incident and take reasonable steps appropriate to the circumstances.
Where applicable law requires notification of an eligible data breach, GigWest will make the required notifications to affected individuals and/or the Office of the Australian Information Commissioner.
18. Children
Performer accounts require the Performer account holder to be at least 18 years old.
GigWest is not designed for children to independently enter commercial Performer Bookings. If GigWest becomes aware that personal information has been improperly collected from a child, we will take reasonable steps appropriate to the circumstances.
19. Complaints
If you believe GigWest has mishandled your personal information, contact gigwestsupport@gmail.com with enough information for us to investigate. We will review the complaint and respond within a reasonable period.
Where the Privacy Act applies and you are not satisfied with our response, you may be able to complain to the Office of the Australian Information Commissioner (OAIC).
20. Changes to this policy
GigWest may update this Privacy Policy when the Platform, providers, law or data practices change.
The current version and last-updated date will be published on the GigWest website. Material changes may also be communicated to registered users where appropriate.
